THE JONES ACT

PROFESSIONAL MARINERS & COMMERCIAL FISHING ACCIDENT

If you were injured while working as a member of a crew aboard a vessel, you are covered under the Jones Act and the General Maritime Law. Generally, when you are injured at sea, you are not entitled to workers compensation benefits. Instead you are entitled to have your employer (or the vessel owner) pay you maintenance (living expenses while injured), cure (medical benefits) and wages until the end of the voyage.

Container Vessel The Jones Act allows you to sue your employer for any injury caused by negligence (carelessness). Also under the General Maritime Law, if you were hurt because a dangerous condition (unseaworthiness) aboard a vessel you can use for unseaworthiness. The Jones Act and the General Martime law provide injured seaman with remedies of money damages for your pain, suffering, lost wages, lost benefits (vacation/ fringe benefits) and reduced earning capacity.
