Driver cut from wreckage in Taconic State Parkway crash

On May 19, 2020, the driver of a 1994 Chevy van that rolled over after it left the southbound Taconic State Parkway south of Exit 8 had to be cut from the wreckage. New York State public information officer said the 77-year-old Mahopac resident was southbound near Exit 8 when his van drifted toward a vehicle in the left lane. The driver over-corrected and veered hard to the right, then over-corrected again to the left, across several lanes, ending up in the center median, where the van rolled over onto the driver's side. The driver, the sole occupant of the van, sustained serious injuries that did not appear to be life-threatening. He was transported to Westchester Medical Center by the Briarcliff Manor Ambulance Corps.

Members of the Hawthorne, Millwood and Ossining Volunteer Ambulance Corps, and the Briarcliff Fire Department and EMS responded to the scene of Tuesday's rollover on the southbound Taconic State Parkway in Mount Pleasant. State Police Troop K Spokesman stated that 77-year-old Mahopac man sustained serious injuries that were not believed to be life-threatening. Under New York's no fault law, this driver who appears to have been at fault for the accident, because he failed to maintain proper control of the vehicle, is entitled to no fault benefits. 

New York sets strict limits on when you can and cannot file a claim for no fault benefits. For starters, the state’s no-fault law doesn’t distinguish between the driver who was to blame for the accident and the driver who followed the law. Instead, New York law places the burden on each driver’s insurance company, which must pay for all accident related damages to the tune of $50,000. That includes medical bills, lost wages, and additional expenses incurred as a result of the accident. To be entitled to no fault benefits, all an injured motorist or occupant of a vehicle involved in an accident must do, is to file an application for no fault benefits with the insurance company within thirty days of the accident.
