PAIN AND SUFFERING– PROVING THE CASE– WHAT IS THRESHOLD?
The New York legislature passed a terrible law, which requires that you have a “Serious Injury” to be able to recover any money for pain and suffering as a result of a car accident. The definition of serious injury requires that the car accident caused you to sustain either (i) a fracture (ii) disfigurement (iii) dismemberment (iv) loss of an organ, (v) an injury or impairment that caused you to be unable to work during 90 out the first 180 days after the accident (vi) a consequential limitation or a significant limitation of your body.
The definitions of some of these catgories are so vague that the Courts have come to different conclusions as to what qualifies. Unfortunately many car accident cases have been lost because people were not injured badly enough to sue. Many other cases have been lost because of inexperienced lawyers who do not know how to prove these cases and because of sloppy doctors who do not do the tests necessary to document the injuries and their effects.
