Our experienced truck accident lawyers are familiar with the common causes of truck accidents. One of the major causes of commercial truck accidents in New York City, Long Island, and New York to be distracted truck drivers. Truck drivers often drive long distances and spend a lot of time on the road. These truck drivers often day dream, left their attention drift, use their cell phones, text, web surf and even play on facebook while operating commercial vehicles. This is a recipe for disaster because the size of these trucks magnifies any unintended motion which results from inattentiveness. According to the Department of Transportation, drivers who text have a 23.2 greater risk of being involved in a safety-critical event such as a crash, near-crash, unintentional lane deviation. The Federal Motor Carrier Safety Administration also reports that commercial truck drivers that dial or talk on a (non hands free) mobile phone while driving, have an increased risk of six times higher than the average driver of having a safety-critical event.
To combat the growing problem, the United States Department of Transportation, Federal Motor Carrier Safety Administration had issued new regulations which prohibit commercial drivers from texting while driving. Texting is broadly defined as entering alphanumeric text into, or reading text from, an electronic device. This broad definition of texting encompasses almost any electronic transmission from a cell phone. Not only does this rule prohibit actually using a phone while driving a truck, the rule goes further and prohibits commercial truck drivers from even reaching for or holding a mobile phone to conduct a voice communication, as well as dialing by pressing more than a single button*. * These tougher regulations carry heavy fines in an attempt to discourage any text or mobile phone operation, which is not truly hands free. These new civil penalties can be as high as $2,750 and for multiple offenses the driver’s license can be disqualified. Motor carriers are also prohibited from requiring or allowing their drivers to text or use a hand-held mobile phone while driving and may be subject to civil penalties up to $11,000.
