WESTCHESTER CONSTRUCTION INJURY ATTORNEYS NEW YORK CITY LEVEL TALENT IN WHITE PLAINS
Our White Plains construction lawyers know that all Westchester construction workers are protected by New York’s Labor Laws. So in addition to being eligible for workers compensation benefits, most construction workers who are injured in Westchester, including on construction projects in White Plains, Rye, Scarsdale, Yonkers, Port Chester, Greenburgh, Elmsford, Valhalla, Ossining, Mt. Vernon, Yorktown Heights and New Rochelle, can also sue the landowner and the general contractor. New York's Labor Laws that protect construction workers who suffered personal injuries in job site accidents are Labor Law 200, 240 and 241. It does not matter if your boss provided the tools or the equipment, because New York law makes the safety obligations non-delegable, which means the general contractor and owner are responsible for the safety of the site.
If you were injured because of an unsafe equipment, unsafe work practices or a dangerous condition on a Westchester job site, our construction accident lawyers in White Plains have the experience to get you the money you deserve. New York's Labor Laws require that construction workers have safe and sturdy ladders, scaffolds and fall protection. The regulations also cover cranes, heavy equipment used during hoisting, so if you got hurt because you were struck by a beam, or materials that were being hoisted, you have a lawsuit. Other regulations require the that excavations and trenches be properly shored and braced, so if you got hurt because of a cave in, then you probably have a lawsuit. Other regulations that protect construction workers require that excavation and demolition be performed in a safe manner, so that if you were struck by heavy equipment such as an excavator or bull dozer, or you were hit by falling materials, then the Labor Law was violated and you have a law suit.
The "Ladder Law"
Our Westchester ladder accident lawyers know that ladders are a key tool of the trade for many workers on construction sites, including electricians, HVAC mechanics, carpenters, plumbers and painters. The Labor Law requires that construction workers who are working on ladders, have safe ladders. This means that the ladder has to be secure and stable against movement. If a ladder isn't strong enough to support the worker and his materials, or if the ladder moves, or slides, then the Labor Law was violated and you have a lawsuit. Some of the common accident accidents which our lawyers have handled includes accidents because the ladder's footing damaged and the ladder rocked or straight ladders that slipped, because they were not tied off or did not have a worker at the bottom holding the ladder or footing that prevented movement. Another common type of accident that our construction injury lawyers see frequently involves ladders that are too short for the job, so the worker has to tie two ladders together or stand on the top rung and climb up to a higher level. The Industrial Code requires that ladders extend past the level that the worker has to access. Another common cause of ladder accidents is the rungs being broken or the braces not being firm, which causes the ladder to move under the worker.
If you were injured on a Westchester job site because you were given a ladder that wasn't safe and secure, call our Westchester ladder law attorneys for a free consultation.
SCAFFOLD CASES
Working on scaffolds is a daily part of life for alot of Westchester construction workers, including masons, plumbers, painters and carpenters. New York's "Ladder Law", also covers scaffolds and requires that workers who work on scaffolds, be provided with safe and secure scaffolds, which is suitable for the work which they have to perform. Our Westchester construction work place accident lawyers also handed countless cases involving scaffold collapses where the scaffolds are overloaded or improperly stabilized. Often materials, such as bricks are stored on the scaffolds which exceed the capacity of the scaffold to hold them. Sometimes, workers are doing demolition or drilling into a wall and the debris from the demolition falls onto the scaffold and the weight causes the scaffold to tilt or collapse. A lot of pump jack type scaffold collapses are seen, along with a lot of excavation type accidents. Another common type of accident, occurs where a plank is used and the plank is inadequate for the load and breaks. These are the more frequent types of scaffold accidents seen on Westchester construction sites.
If you were injured on a Westchester construction site because of a dangerous scaffold, call our White Plains construction accident attorneys for a free consultation.
FALL PROTECTION
If you were injured because you fell from an unprotected height, you probably have a law suit under Labor Law 240. New York's Labor Law 240 requires adequate protection for workers who are working at dangerous heights. New York law has recognized anything over four feet to be a sufficient height to require protection. If you work at a height or over an unprotected height, the building owner and general contractor are required to provide you with fall protection, including lanyards, harnesses and lines. If they don't and you get hurt, then they can be sued.
Roofers are constantly exposed to the risk of falling and often are pressured to not secure harnesses by nailing in, because it takes additional time to do the repair. Likewise, iron workers, steam fitters and carpenters, as well as bridge workers are constantly working at unprotected heights and over areas that they can fall through. Our Westchester construction accident lawyers know how dangerous this work is and that everyone deserves to go home at the end of the day. If you were injured because the boss didn't provide fall protection, pressured you not to use it, or the fall protection wasn't adequate, call us for a free consultation.
