Construction Accidents In New York Having To Do With Demolition. By Michael Joseph on July 23, 2011

Construction accident attorneys in New York often see injuries to construction sites that involve personal injurycaused by unsuccessful work practices during demolition . Unfortunately for the injured workers in New York , not all demolition work is covered by the Labor Laws of New York.

For the purposes of Labor Act 241, demolition is based on 12 nycrr 23 to 1.4 (b) (16) as the eventual or associated work with the total or partial decommissioning or demolition of a building or other structure such as removal or dismantling Machinery or other equipment. Therefore to be covered under the New York Labor Law the injured worker in demolition should have been participating in the construction of a structure. In a recent decision, the New York courts found that the dismantling of a vehicle, be it a boat, a car or otherwise unrelated to any other project, is not the type of demolition intended to be included in the New Labor Act York.

Construction workers taking part in ladololition in New York often suffer serious personal injury, including death by negligence when struck by the fall of debris. Our construction accident attorneys in New York have often used the New York Labor Law 241 to successfully represent injured construction workers. Lawyers representing injured demolition workers in New York must be familiar with the new provisions of the New York industry code with regard to demolition. (B) (3) establishes that parts of buildings shall not be left unattended under conditions such that such parts may be dropped, Collapse or be weakened by the pressure of the wind or vibration. 12 (3.3) (c) provides that during hand demolition operations, inspections shall be made continuously by persons designated to detect hazards arising from depleted or deteriorated plants or walls or loose material and require the protection of the demolition worker Of New York against such dangers, by propping up, reinforcing and other effective means.

Section 23-1.7 (a) (1) of the Labor Code also requires that all places where persons are required to work or pass because they are normally exposed to falling material or objects must be provided with adequate overload protection.

Construction accident attorneys in New York must therefore be aware of these demolition-related regulations.
